(049) Contracts: Don’t Be Afraid
Translators deal with contracts most of the time in their careers. Contracts from civil law jurisdictions are very different from the ones from common law jurisdictions. The speaker will discuss the main differences between Brazilian and American contracts and show clauses that can be problematic. The speaker will examine the translations of a few words and expressions. The main goal will be to compare and contrast the structure of contracts and suggest ways for linguists to translate terms more effectively and naturally.

(103) Company Reorganization: We Need to Talk about It
Company reorganization is a trendy topic around the world. Brazil passed a law in 2020 that makes it easier for judges to cooperate with their counterparts from other countries to recover assets from companies that have filed for bankruptcy. We do expect an increase in this kind of lawsuit. It will affect negotiations between and among companies and law firms. Translators must be prepared for this line of work. The presenter will go through company reorganization procedures in the U.S. and Brazil and will discuss vocabulary and terminology used in this field.

(119) Police Interpreters from Vose (1892, Massachusetts) to Lopez-Ramos (2019, Minnesota): “Conduit” Shifted the Paradigm from the Sixth Amendment to the Fifth Amendment
Using the “agent and/or conduit” theory to circumvent police interpreters’ Sixth Amendment hearsay rules continues to dominate U.S. courts despite its problematic application to ad hoc interpreters. This Sixth Amendment hearsay paradigm presents two equally unacceptable alternatives to professional interpreters: “conduit” with hearsay immunity or “hearsay” requiring in-court testimony, possibly compromising impartiality and confidentiality. Based on empirical data from 228 federal and state appellate rulings from 1850 to 2018, the speaker will demonstrate that the Sixth Amendment hearsay/conduit paradigm is unworkable because “conduit” is fundamentally a Fifth Amendment paradigm issue that requires electronic recording for accuracy verification by qualified interpreters as expert witnesses.

(015) Lots of Resources for LOTS Interpreters
This session is intended for interpreters of languages other than Spanish (LOTS). These are the interpreters who don’t always have the luxury of ready-made interpreting practice tapes. LOTS interpreters must be creative and think outside the box when it comes to study materials and finding resources. Attendees will learn how to do just that. They’ll learn the benefits of having a study partner and how to use language-neutral materials to create their own language-specific study exercises. (AST-03) Interpreting for Depositions: Advanced Skills, Ethics, and Best Practices
As some court systems have reduced the rates for judiciary interpreters, many court interpreters are actively looking for assignments outside the court system. There are plenty of opportunities available at depositions, which are typically held at law offices. There is little training focusing on the role of interpreters in depositions, and this workshop will provide an in-depth overview. Topics will include ethical conundrums, the role of check interpreters, stand-by interpreting, best practices, tips for correcting mistakes, and sample deponent responses. This will be an advanced training workshop for interpreters who are already familiar with interpreting for depositions. The basics will only be reviewed briefly.
